After the Kosovo Ministry of Industry, Entrepreneurship, and Trade confirmed yesterday that the license of the company MTS d.o.o. – a subsidiary of Telekom Srbija in Kosovo has been revoked, Telekom reacted, criticizing Pristina’s move. The company said that it was a decision not in line with the procedure.
Kosovo Ministry of Industry, Entrepreneurship, and Trade announced on Tuesday night that MTS d.o.o. is one of fifteen companies whose license has been revoked for allegedly submitting documents with „unconstitutional content“ during registration.
„During registration, the companies submitted documents that are contrary to the constitutional principles and laws in force in the Republic of Kosovo,“ the ministry underlined.
MINT announced that these 15 companies presented content such as: „Pec, Republic of Serbia“; „Pec, SRB“; „Gnjilane, Serbia“; „Pristina, Serbia“; „Djakovica, Republic of Serbia“, „Kosovska Mitrovica, Republic of Serbia“, etc. They also shared a list of companies whose licenses have been revoked, including MTS d.o.o.
Telekom soon reacted, denying these allegations.
„The company MTS d.o.o., as a subsidiary of Telekom Srbija, absolutely and fully conducts its business as per Pristina’s regulations. Namely, extracts from the register for MTS d.o.o. do not read ‘Kosovska Mitrovica, Republic of Serbia’ in any document, in fact it does not say ‘Republic of Serbia’ anywhere,“ they said.
They specified that the company was legitimately established in accordance with the ratified Brussels Agreement by Pristina, as per local regulations and using certificates recognized by Pristina, which can be seen in the extract from the register itself.
„The full documentation is fully in accordance with the regulations of Pristina, as well as all the personal documents of the legal representatives,“ Telekom Srbija emphasized.
They stress that the only questionable document for Pristina is the alleged existence of a Serbian passport in the registry archive, where the place of birth is reportedly listed as „Kosovska Mitrovica, Republic of Serbia“.
This company also shared part of the text of the decision of the Business Registration Agency regarding the revocation of the certificate.
Telekom Srbija emphasizes that apart from the decision itself, they do not have access to the MINT Commission’s report related to the issue, nor the documents themselves, which were used as alleged evidence.
This company, however, argued that the information about the passport does not appear in any official statement or other identification document of the register of MTS d.o.o., but that only Zoran Milojevic’s identity card issued by Pristina is attached.
„From the submission of documentation to the registry, from the establishment onwards, there is no information in the archive that Zoran Milojevic’s passport was ever used. Moreover, according to information from Zoran Milojevic, he was never issued a passport under the serial number 008526874, neither valid nor expired. Even if a copy of a passport was ever submitted (as far as is known, it does not even exist), from all the documents, including the decision itself, it is not at all clear why that passport would be legally relevant, when it is not used for any registration document,“ they emphasized.
They state that it is unclear to them how „place of birth“ can offend the Constitution and public order of Kosovo:
„When at the time when Zoran Milojevic was born – 1968, it was the Republic of Serbia, the same as for almost all citizens from the former Yugoslavia, the documents list SFRY as the place of birth.“
If it was about the place of current residence, as ‘current’ information, then there is room for discussion, but that is not the case here
At the same time, they add that the decision on removal from the registry states that the name used for his place of birth and country represents „a violation of alleged constitutional norms that also allegedly represents a serious threat to public security.“
At the same time, it is „completely unclear“ how the place of birth can have any legal consequences, even in terms of removing the legal representative, „let alone liquidating the entire company,“ they add.
Telekom Srbija sent a request to obtain a copy of the alleged passport.
Last week, the company Telekom Srbija announced that the Kosovo Business Registration Agency made a decision to revoke the business license of the company MTS d.o.o. At the time, however, they also said that the Agency’s decision was still unenforceable, announcing that they would file an appeal within 30 days.
