The Basic Court in Urosevac removed a KSF member (A.K.) suspected of wounding two Serb boys – S.S. (11) and M.S. (21) in Gotovusa on Christmas Day from police custody and ordered him to be placed under house arrest instead. A.K. was charged with „causing general danger“ and „the use of a firearm“, the lawyer of one of the wounded boys, Milos Delevic, confirmed for KoSSev portal. Delevic revealed that he would insist on the reclassification of the criminal offense into „attempted aggravated murder“. On the other hand, A.K.’s defense counsel believes that this criminal offense did not take place and that he actually „acted in self-defense“.
A young boy S.S. (11) and a young man M.S. (21) of Serbian ethnicity were wounded on Christmas Day in the village of Gotovusa near Strpce when they were shot at from a passing car.
Immediately after the incident, a thirty-three-year-old Kosovo man, A.K. a member of the KSF, was detained.
The first hearing in connection with this case was held on March 9th. According to Delevic, the indictment, as well as the case files, were written in the Albanian language. The lawyer then demanded that the hearing be postponed until the documents were translated into Serbian.
A new hearing was held today.
Delevic told KoSSev that, the defendant, A.K. pleaded not guilty to the crimes he is charged with.
At the same time, the accused’s defense attorney submitted a request to change the measure of custody to house arrest, which the court accepted today and the defendant was remanded to two months of house arrest.
The custody request, however, in addition to causing general danger and use of a firearm, also included the charge of „attempted aggravated murder.“ However, this criminal offense is not included in the current indictment.
„This is the phase of examining the indictment, his defense attorney will file an objection to the indictment and then the main trial and presentation of evidence will begin,“ said Delevic, adding that he will also submit evidence to prove that the criminal offense of „attempted aggravated murder“ took place.
„We will insist that the qualification be changed because the court is not bound by the qualification in the indictment,“ said Delevic.
At the same time, he specified that he objected to the decision to place A.K. under house arrest „because it is a serious crime, two young men, boys, were wounded and the public was greatly disturbed.“

Defense lawyer Kutjim Kerveshi confirmed that A.K. was placed under house arrest in a Facebook post: „A. K. is sleeping next to his family tonight!’
He also announced that A.K. pleaded not guilty.
Kerveshi also shared what he described as a theory of the defense – that A. K. actually acted in self-defense.
„As the defense believes that there was no attempt aggravated murder, the defense continues to advocate for a fair and independent process that will prove A.K.’s innocence,“ he stated.
He then thanked the media who „reported about the case professionally and sensibly.“
„Those with bias against A.K., who stigmatize him, and/or give an ethnic context to the case in question, give him epithets that the court did not give with a final decision, as I said today in front of the media, will face justice!“ – warned Kerveshi.
„The Republic of Kosovo is not a country that is based on some fragile crystals that I can break whenever I want, this country has rules, it is sovereign, it has an identity and institutions!“
Kerveshi also said that, although the defense does not agree with the indictment nor with the decision on house arrest, it will respect them and „seek confrontation only with institutions and legal channels, believing in justice and the rule of law.“
