Gjinovci on Kurti’s allegations against the Special Court: „Icing on the cake“ evidence of political meddling with justice

„Kurti’s conference from today is the icing on the cake evidence that political meddling with justice in Kosovo is the same in every party,“ the executive director of the Organization for Improving Quality in Education (ORCA), Rron Gjinovci reacted to Albin Kurti’s latest series of accusations against the Special Court. Gjinovci described Kurti’s address as one of the „weakest, most pathetic and wide of the mark public appearances.“

Furthermore, as an alternative to the viral slogan „Freedom has a name – KLA“, he sent the following message: „Freedom has a name, the truth is its name. And the truth sets us free.“

During a press conference held today, the former Kosovo PM, Albin Kurti alleged that Kosovo Specialist Chambers are unjust and biased against the KLA as a warring party, but also against ethnic Albanians.

Gjinovci reacted to Kurti’s claims on his Facebook page later in the day, criticizing the former Kosovo PM’s critical approach to the war crimes court.

The executive director of the Organization for Improving Quality in Education (ORCA) and a member of the presidency of the Association of Kosovo Philosophers, Rron Gjinovci stressed that „for two weeks in a row, the third part of Kosovo’s government – the judiciary – has been under intensive attack.“

He recalled that the formation of the Special Court has been regulated via amendments to the Kosovo Constitution, and voted in by two-thirds of the members of the Kosovo Assembly.

„I still do not understand why people see this court as foreign when it is defined in our Constitution,“ Gjinovci noted.

„Politics, and not just politics, openly meddled in the judicial system without receiving the slightest attention for such meddling. Today, it culminated with the president of the largest party in the country acting as an analyst of the prosecution’s files,“ Gjinovci wrote in a Facebook post, adding a facepalming emoji.

„Today you had the last great attack on the independence of the judiciary, on the division of authority. Also, the last great evidence for the international community that Kosovo does not possess internal factors which are prepared for the impartial pursuit of justice,“ this young activist pointed out.

He also stated that there are no conditions to hold war trials in Kosovo and that no such conditions have been present.

„You confirmed the malicious Serbian, Russian and international claim that Kosovo is unable to deliver justice, and as a result, it lacks the main component of the state,“ he added, warning of a mass exodus from Kosovo if existing policies continue.

„Freedom has a name, the truth is its name. And the truth sets us free,“ Gjinovci said, alluding to the slogan which went viral several weeks ago, and which was shared by the top Kosovo officials and diplomats – „Freedom has a name – KLA“, shared along with the emblem of the former „KLA.“

In a follow-up Facebook post, Gjinovci revealed, next to a facepalming emoji, that he is „fascinated“ by Kurti’s request for „the state of Kosovo to organize the defense of Thaci, Veseli and Krasniqi.“

„Albin is proposing something unprecedented to date – a state going against a state. The Special Court is also the state of Kosovo, defined by Article 103, item 7 of the Constitution of the Republic,“ he wrote, emphasizing:

„There are two possibilities: either he doesn’t know this, or he is playing a political game to the detriment of justice. Both are scandalous.“

What Kurti said today

„The Special Court is unjust and biased against the KLA as a warring party and toward our Albanian ethnicity. The establishment of this court is contrary to our individual and collective memory -human and political,“ Kurti assessed today.

He also claimed that the Special Court was “superimposed” on Kosovo.

Kurti, who presents himself as a Social Democrat, has repeatedly pointed out that Kosovo does not need a Special Court for crimes in Kosovo, noting that it was formed to cover the failure of the UN and EULEX.

Last spring, as the outgoing prime minister, Kurti fired his political adviser, Shkelzen Gashi – only a day after Gashi said that „KLA members committed war crimes“ during a guest appearance on a talk-show, which stirred an avalanche of negative comments in the Kosovo public.

The Self-determination movement has strongly opposed the establishment of the Specialist Chambers over the past couple of years.

Rexhep Selimi, the head of the parliamentary group Self-Determination, is one of the four high-ranking KLA officials who are currently in The Hague and against whom the indictments have been confirmed.
